Digital Product License Agreement

This Licence Agreement governs the use of all digital products (“Materials”) sold by Divergent Within (“we”, “us”, “our”). By purchasing, downloading, or using the Materials, you agree to the terms of this Agreement. If you do not agree, do not purchase or use the Materials.

1. Ownership of Materials

All Materials are the intellectual property of Divergent Within and are protected by Australian copyright law.

This licence grants you a limited right to use the Materials. No ownership, copyright, or intellectual property rights are transferred.

2. Licence Types

A. Individual / Client Licence

This licence is intended for personal use only.

Under this licence, you may:

  • Download and use the Materials for your own personal reflection, learning, or wellbeing

  • Print copies for your own personal use

You may not:

  • Share the Materials with others

  • Upload the Materials to any website, portal, or social media

  • Reproduce, adapt, modify, or create derivative works

  • Use the Materials in any professional, therapeutic, teaching, or training context

  • Sell, sublicense, or distribute the Materials in any form

This licence applies to private individuals and clients only.

B. Professional Use Licence

This licence is required if you intend to use the Materials with clients, patients, students, or groups, or in any professional context.

Under this licence, you may:

  • Use the Materials with your own clients in therapy, assessment, coaching, or psychoeducation

  • Provide copies directly to your clients or patients (digital or printed)

  • Use the Materials in small-group settings, workshops, or training that you personally deliver

You may not:

  • Re-sell the Materials as a standalone product

  • Upload the Materials to public websites, portals, or shared drives

  • Include the Materials in online courses, memberships, or downloadable bundles

  • Modify, rebrand, or remove Divergent Within branding

  • Claim authorship of the Materials

Attribution is required where appropriate: “Materials © Divergent Within. Used under licence.”

Each Professional Use Licence is single-practitioner only. Group practices, organisations, or training providers must obtain a separate agreement.

3. Prohibited Uses (All Licences)

You may not, under any licence:

  • Sell, sublicence, or commercially exploit the Materials

  • Distribute the Materials widely or publicly

  • Upload the Materials to file-sharing platforms

  • Remove copyright notices, watermarks, or branding

  • Use the Materials in any way that misrepresents Divergent Within

4. Educational Nature of Materials

The Materials are provided for educational and reflective purposes only.

They do not constitute:

  • Psychological treatment

  • Medical advice

  • A substitute for therapy, diagnosis, or clinical care

Use of the Materials does not create a therapeutic or professional relationship with Divergent Within.

5. No Warranty

The Materials are provided “as is”.

We make no guarantees regarding outcomes, suitability for all individuals, or specific clinical results.

6. Termination

We reserve the right to terminate this licence immediately if these terms are breached.

Upon termination, you must:

  • Cease all use of the Materials

  • Delete all digital copies

  • Destroy any printed copies

7. Governing Law

This Agreement is governed by the laws of Victoria, Australia, and applicable Australian Commonwealth law.
